Rise Up Forum (herein referred to as “Rise Up Forum”, “we”, “us” or “our”)provides and makes available this website (this “Site”) to provide Site visitors, Donors and users (“you”,”your”) with information about our organization and access to our platform, resources and services (this Site and such materials and services collectively, the Rise Up Forum Services”).This Terms and Conditions of Services (“Agreement”) between Rise Up Forum and users/ registered members of the website (“You”) describes the terms on which Rise Up Forum offers you the Services (as defined below) through the website. We do not involve ourselves to do sales or business to gain profits for any of the services we provide nor are we liable for any malpractices and losses in the name of Rise Up Forum with regards to the information we receive.

This website is controlled and operated by Rise Up Forum from its Central office in Calicut, Kerala State, India. The laws of Kerala State govern these General Terms and Conditions and your use of the website. We recognize that it is possible for you to obtain access to this website from any jurisdiction in the world, but we have no practical ability to prevent such access. This website has been designed to comply with the laws of Kerala State and Government of India. Those who choose to access the website from other locations do so on their own initiative and are responsible for compliance with local laws if and to the extent local laws are applicable. If any material on this website, or your use of the website, is contrary to the laws of the place where you are when you access it, then the website is not intended for you and we ask you not to use the website. You may not use or export materials on this website in violation of Indian laws and regulations. This website is not intended to subject Rise Up Forum to the laws or jurisdiction of any state, or territory other than Kerala.

If a dispute arises under these General Terms and conditions between you and Rise Up Forum, such dispute shall be resolved in (i) Kerala, India; and (ii) at the filing party’s election, in either a small claims court or by final and binding arbitration administered by the National Arbitration Forum/Tribunal under their rules for consumer arbitration. All disputes in arbitration will be handled solely between the named parties and not on any representative or class basis. ACCORDINGLY, YOU ACKNOWLEDGE THAT YOU MAY NOT HAVE ACCESS TO A COURT (OTHER THAN A SMALL CLAIMS COURT) OR JURY. Notwithstanding any other provision of these General Terms and Conditions, Rise Up Forum may resort to court action for injunctive relief at any time if, in its good faith belief, the dispute resolution procedures described above would permit or cause irreparable injury to Rise Up Forum or any third party claiming against us, due to delay arising out of such dispute resolution procedures.

Your Content- conditions of use

IF YOUR USE OF THE RISE UP FORUM SERVICES OR THE SERVICES CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, NO RISE UP FORUM PARTY SHALL BE RESPONSIBLE FOR THOSE COSTS.

THE RISE UP FORUM SERVICES AND THE SERVICES CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND. THE RISE UP FORUM PARTIES DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF TITLE, MERCHANT ABILITY AND NON‑INFRINGEMENT OF THIRD PARTIES’ RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE.

IN SUCH STATES, THE LIABILITY OF THE RISE UP FORUM PARTIES SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE RISE UP FORUM PEACE FIRST SERVICES, THE SERVICES CONTENT OR WITH THIS AGREEMENT, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF OUR SERVICES.

Indemnification and Release

By accepting these Terms, you agree to release, indemnify and otherwise hold harmless Rise Up Forum, our member, volunteers, affiliates and other partners from any direct, indirect, incidental, special, consequential or exemplary damages resulting from the use of our Services by you or by those who have access to the service through your account. We will provide notice to you of any such claim, suit or proceeding. We reserve the right to assume the exclusive defense and control of any matter which is subject to indemnification under this section

Severability

If any provision of these Restricted Sites Terms and Conditions shall be held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby, and such provision shall be deemed to be restated to reflect the Parties’ original intentions as nearly as possible in accordance with applicable Law(s).

Assignment

The Rise Up Forum is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

These Terms constitute the entire agreement between Rise Up Forum and you in relation to your use of this Website, and supersede all prior agreements and understandings.

If you violate any part of this Agreement, your right to access and/or use the Services Content and the Rise Up Forum Services shall automatically terminate and you shall immediately destroy any copies you have made of the Services Content. If you are blocked by Rise Up Forum from accessing our Services (including by blocking your IP address), you agree not to implement any measures to circumvent such blocking (e.g., by masking your IP address or using a proxy IP address).
